USE OF THIS WEBSITE

You agree to use this website for lawful purposes only and in a way that does not infringe the rights of others or restrict their use and enjoyment of the site. We reserve the right to refuse service, suspend access, or cancel participation at our discretion if these Terms are violated.

SERVICES & OFFERINGS

We offer, including but not limited to: online and in-person yoga classes, one-on-one yoga therapy sessions, workshops and courses, retreats, digital content (videos, recordings, PDFs, guides), and free educational resources and newsletters. Services may be delivered in person (we travel to the client) or online, with global access. Offerings may change at any time without notice.

HEALTH DISCLAIMER, ASSUMPTION OF RISK & WAIVER OF LIABILITY

Yoga, yoga therapy, movement, breathing practices, meditation, and wellness activities involve physical and mental participation and may carry inherent risks. By accessing this website or participating in any services, sessions, classes, retreats, workshops, programs, or content offered by Andre Cavanha LLC and Savyoga, you acknowledge and agree that all services and content are provided for educational and wellness purposes only and are not medical advice, yoga therapy is not a licensed medical profession in the United States, you are responsible for consulting a qualified healthcare professional before participating if you have any medical condition, injury, or concern, your participation is voluntary, and you assume full responsibility for all risks, known or unknown, and services may be led by Andre Cavanha LLC staff, partners, instructors, or qualified professionals affiliated with Savyoga, all of whom are trained and certified in yoga and/or yoga therapy. You understand that it is your responsibility to listen to your body, modify practices as needed, and stop participation if you experience pain, discomfort, or dizziness.

RELEASE & LIMITATION OF LIABILITY

To the fullest extent permitted by law, you agree to release, waive, and discharge Andre Cavanha LLC, Savyoga, and all partners, instructors, contractors, affiliates, and representatives from any and all claims, demands, damages, or causes of action arising out of or related to participation in any in-person or online class, session, retreat, workshop, or program, use or misuse of any content, videos, recordings, PDFs, or materials provided, and physical injury, illness, emotional distress, property damage, or death. This release applies whether such claims arise from negligence or otherwise, to the fullest extent allowed by law. You agree not to bring any legal action against Andre Cavanha LLC or Savyoga related to your participation or use of this website and its offerings. If any portion of this section is found to be unenforceable, the remaining provisions shall remain in full force and effect.

PAYMENTS

Payments are processed through third-party platforms including Stripe, PayPal, and Wise. We do not store your payment information. Prices are listed in U.S. dollars unless otherwise stated and may change at any time.

REFUNDS, CANCELLATIONS & RESCHEDULING

Refund, cancellation, and rescheduling policies vary depending on the product or service. General guidelines: specific policies will be clearly stated at the time of booking or purchase. By completing a purchase or booking, you agree to the policy applicable to that offering. Some offerings (such as digital products or recordings) may be non-refundable. Retreats, workshops, or private sessions may have specific cancellation windows or fees. If no policy is stated, refunds and rescheduling are handled case by case, at our discretion.

Alternative arrangements or credits may be offered at our discretion.

GOVERNING LAW

4.1 GOVERNING LAW: These Terms & Conditions are governed by the laws of the State of Florida, United States.
4.2 EXCLUSIVE VENUE: Any legal action or proceeding arising out of your participation in a retreat or use of this website shall be brought exclusively in the courts of Walton County, Florida

CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of the updated Terms.

RETREAT-SPECIFIC ADDENDUM.

1. The Precedence & Transfer Clause (Update your Refund Section)

1.1 PRECEDENCE: For the Prana Retreat (May 30 – June 5, 2025) and all future retreats, the specific Cancellation & Refund Policy provided on the booking page at the time of purchase takes precedence over any general refund guidelines listed elsewhere in these Terms.
1.2 NON-TRANSFERABILITY: Retreat bookings and the €500 deposit are strictly non-transferable to other individuals or future retreat dates unless specifically authorized in writing by Andre Cavanha LLC. American Express Merchant Guidelines

2. Medical Emergency Authorization (Update your Health Section)

2.1 EMERGENCY CONSENT: In the event of a medical emergency during an in-person retreat, you authorize Andre Cavanha LLC and its representatives to seek and consent to medical or hospital care rendered upon the advice of a licensed physician.
2.2 FINANCIAL RESPONSIBILITY: You agree to be solely responsible for all costs incurred for such treatment, including transportation (ambulance/evacuation) and hospital fees.

3. FORCE MAJEURE 

3.1 FORCE MAJEURE: Andre Cavanha LLC shall not be liable for any failure to perform its obligations if such failure results from circumstances beyond its reasonable control (“Force Majeure”), including but not limited to natural disasters, fire, flood, war, political unrest, epidemics, or government-imposed travel restrictions.
3.2 REMEDY: In such cases, Andre Cavanha LLC reserves the right to cancel or postpone the event. Refunds in Force Majeure scenarios will be issued minus any non-recoverable costs already committed to vendors.

CANCELLATION & REFUND POLICY

1. Non-Refundable Deposit

To secure your spot for the Prana Retreat (May 30 – June 5), a non-refundable deposit of €500 is required. This deposit is non-refundable and non-transferable, as it is used to guarantee your room and retreat amenities.

2. Payment & Cancellation Schedule

Until March 30 (60+ days out): Cancellations will receive a refund of any “Balance” paid (Total price minus the €500 deposit).

March 31 – April 30 (30–60 days out): 50% of the “Balance” paid is refundable. The €500 deposit remains non-refundable.

After May 1 (Less than 30 days out): No refunds or credits will be issued under any circumstances.

3. Travel Insurance (RECOMMENDED)

Because we must commit all funds to our venue and staff by May 1st, we cannot make exceptions for illnesses, family emergencies, or travel delays. We strongly recommend you purchase Travel Insurance to cover your costs should you need to cancel last minute.

4. Legal Identity

This retreat is operated by Andre Cavanha LLC. All transactions and legal agreements are processed under this entity.
